Re: 2009 McKesson Suit
This letter is in response to a VSEA inquiry to provide information regarding a class action
lawsuit pending in federal court in Boston, Massachusetts. Under this suit, you may be eligible
to obtain reimbursement for prescription drug co-pays made between August 1, 2001 and
March 15, 2005.
The suit is called “New England Carpenters Health Benefits Fund et al. vs. First DataBank Inc.
and McKesson Corporation”. More information and instructions on how to file a claim can be

Please note that if you wish to file a claim, the deadline, July 9, 2009, is fast approaching. You
should review the information on the McKesson Proposed Settlement website, under the
Consumer Copay Class. The State Employee’s Prescription Drug plan with Express Scripts (ESI)
does use First DataBank (FDB) for drug pricing information. The necessary claim form is on the
website, along with a list of brand name drugs included in the settlement.
You may obtain your prescription drug history either from your pharmacy or by calling Anne
Carver at 802.828.0648, or Jerry Fry at 802.828.3455. Due to the time span for this suit, the
drug history retrieval process is a manual one and expected turnaround time is 48 to 72 hours.
The Employee Benefits Unit will send requests to ESI as they are received, however any request
received after 2pm will not be able to begin processing by ESI until the following day.
